These Terms of Service ("Terms") govern your use of the Rattlewise — Noise & Vibration Finder application ("the App") published by Bulpara Inc ("we", "us", "our"). By downloading or using the App, you agree to these Terms.

1. Service Description

Rattlewise is an iOS application that helps you locate the source of rattles, buzzes, and vibrations in cars, EVs, vans, and homes. It plays a frequency sweep to excite a rattle, displays a live FFT spectrum with peak tracking, can use the device accelerometer to confirm structure-borne vibration, produces a confidence-ranked list of likely culprits with a guided fix checklist, and generates a shareable before/after report. All measurement and analysis runs on your device.

2. Important Limitations

Rattlewise is a guidance tool, not a laboratory instrument or a guaranteed diagnosis. You understand and agree that:

• Use the App only while parked or stationary — never while driving. Locating a rattle requires your attention on the screen and on the vehicle's interior.
• The App surfaces likely sources, ranked by confidence. It does not and cannot guarantee that a named part is the true source of a given noise.
• Frequency and dB readings depend on your device's microphone and accelerometer, ambient noise, and how you position the phone. They are approximate and intended for relative comparison (before vs. after), not certified acoustic measurement.
• The App is intended for light-to-moderate cabin and room rattles. Some noises (mechanical faults, drivetrain, brakes, structural issues) cannot be located this way and may require a professional.
• The App makes no safety, mechanical-soundness, roadworthiness, or medical claims. It is not a substitute for inspection by a qualified mechanic or technician.

3. Acceptable Use

You agree to use the App only for lawful purposes and only on vehicles, spaces, and equipment you own or have permission to inspect. You agree not to:

• Use the App while operating a vehicle or any machinery
• Rely on the App as the sole basis for a vehicle sale, purchase, repair, or safety decision
• Reverse engineer, decompile, or extract the App's diagnosis logic or assets
• Attempt to circumvent subscription restrictions or free-tier limitations
• Use the App in any manner that violates applicable laws or third-party rights

4. Subscriptions & Billing

• Free tier: No charge. Live FFT spectrum and peak tracking, the full guided tone & frequency sweep, one live "find the buzz" session at a time, and a diagnosis preview (top likely culprit). No ads.
• Premium Monthly: $4.99/month. Unlimited saved hunts, the full ranked diagnosis with guided fix checklists, shareable before/after proof reports, multi-session history per vehicle and space, accelerometer structure-borne fusion, and PDF/CSV export.
• Premium Annual: $24.99/year (save 58% vs. monthly), with a 7-day free trial. Same Premium feature set as monthly.
• Subscriptions are billed through the Apple App Store and are subject to Apple's Terms of Service.
• Payment is charged to your Apple ID at confirmation of purchase. Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period.
• You can manage and cancel your subscription through your Apple ID settings. Cancellation takes effect at the end of the current billing period.
• If you cancel during a free trial period before the trial ends, you will not be charged.
• We reserve the right to change pricing with 30 days' notice. Existing subscribers retain their original price for the remainder of the active term.

5. User Content

Hunts, proof reports, history, and preferences are stored locally on your device. You retain all rights to the measurements and notes you create. We do not access, collect, or store your content on any server.

6. Intellectual Property

The App, including its design, code, diagnosis logic, and packaged content, is owned by Bulpara Inc and is protected by copyright and other intellectual property laws. You receive a limited, non-exclusive, non-transferable license to use the App for its intended purpose.

7. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE ERROR-FREE OR UNINTERRUPTED, OR THAT IT WILL CORRECTLY IDENTIFY THE SOURCE OF ANY GIVEN NOISE OR VIBRATION.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BULPARA INC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE APP, INCLUDING BUT NOT LIMITED TO:

• Repairs, parts, or labor undertaken based on the App's suggested likely culprits
• Decisions made based on a measurement or proof report (a vehicle sale, purchase, or dispute)
• Any injury, damage, or loss resulting from using the App while driving or operating machinery
• Subscription-related charges that fall under Apple's billing policy

9. Indemnification

You agree to indemnify and hold harmless Bulpara Inc from any claims, damages, or expenses arising from your use of the App, including any repairs you undertake or decisions you make based on its output.

10. Termination

We may terminate or suspend your access to the App at any time, without notice, for conduct that we believe violates these Terms or is harmful to other users or the business.

11. Changes to Terms

We may update these Terms from time to time. Changes will be posted on this page with an updated revision date. Continued use of the App after changes constitutes acceptance of the revised Terms.

12. Governing Law

These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict of laws provisions.
